This is a Smart Contract agreement Sealed between (“Drax Energy”, “we”, “us”, or “our”) a company registered in United Kingdom under registration #07126582, Drax Energy, and you (together with Drax Energy, the “Parties” and each a “Party”). By using any Drax Energy service, whether through Drax Energy, any associated website, you agree that you have read, understood, and accept all of the terms and conditions contained herein (the “User Agreement”), as well as our Privacy Policy.


By using the Drax Energy Site and entering into this User Agreement, you affirm that you are an individual, at least 18 years of age or older, have the capacity to enter into this User Agreement and agree to be legally bound by the terms and conditions of this User Agreement, including the Policy, the Privacy Policy and the Trading Principles as incorporated herein, as can never be backed out by any of the party or be interrupted by any third party. In order to use the Services, you may be required to provide certain identifying information pursuant to our Compliance Program.


We grant you a limited, non-exclusive, non-transferable licence to access and use the Services and the Drax Energy Site solely in accordance with the terms of this Agreement. Your relationship with Drax Energy use of any of the Services may be subject to the laws, regulations, and rules of governmental or regulatory authorities in your or our jurisdiction (Applicable Law). By entering into this User Agreement, you agree to act in compliance with and be legally bound to any and all Applicable Law.


When you create a Drax Energy trading Wallet, the Wallet software generates a cryptographic public key pair that you may use to trade our supported Virtual Currency via our relevant Virtual Currency network. YOU MUST STORE, OUTSIDE OF THE SERVICES, YOUR WALLET CREDENTIALS, INCLUDING YOUR PASSWORD, USERNAME AND E-MAIL ADDRESS. If you do not maintain a backup of your Wallet data outside of the Services, you will not be able to access your trading account and We are not responsible for maintaining this data on your behalf.


With respect to your trading Wallet, Drax Energy does not receive or store your trading Wallet password, nor any keys, network addresses or your transaction history. We cannot assist you with Trading Wallet password retrieval. You are solely responsible for remembering, storing and keeping secret your Wallet password. Your trading Wallet may become inaccessible if you do not know or keep secret your Wallet password. Any third party with knowledge of one or more of your credentials (including, without limitation, your username or password) can dispose of funds in your trading Wallet.


When you create a Wallet, you must: (a) create a strong password that you do not use for any other website or online service; (b) provide accurate and truthful information; (c) protect and keep secret all credentials for the Wallet; (d) protect access to your device and your trading Wallet; (e) promptly notify us if you discover or otherwise suspect any security breaches related to your Wallet.


You agree to take responsibility for all activities that occur with your Wallet and accept all risks of any authorised or unauthorised access to your Wallet, to the maximum extent permitted by law.


We don't charge any fees or extra fees for our services of any type.


Drax Energy stores your Personal Data at secure locations in the EU. Drax Energy ensures that appropriate security standards are in place regarding the safeguarding, confidentiality, and security of Data.


The information that we collect from you will be transferred to, and stored in, destinations outside of your country and the European Economic Area ("EEA") as described below:


We may transfer your Personal Data outside the EEA and the UK to other company subsidiaries, service providers and business partners (i.e., Data Processors) who are engaged on our behalf. To the extent that we transfer your Personal Data outside of the EEA and UK, we will ensure that the transfer is lawful and that Data Processors in third countries are obliged to comply with the GDPR and the UK Data Protection Act 2018.
